1.3. By using the website or placing an order, you confirm that you have read, understood, and accepted these Terms and Conditions.

1.4 By attending any of our events, massages or spa services in person you hereby confirm you have fully read, understood and accepted the description and nature – Please call or write to us if you have any questions.

2. Definitions

Customer / User – a natural person, legal entity, or organization placing an order or using the store.
Consumer – a natural person purchasing for purposes not directly related to business activity.
Store / Seller – Emerald Spa, the operator of the online shop.
Goods / Products – physical products available for sale in the store.
Order – a declaration of intent by the customer to purchase specific products.

3. Placing Orders

3.1. Orders can be placed via the website 24/7.
3.2. To place an order, the customer must:

Select products and add them to the cart.
Provide accurate personal and delivery details.
Choose the payment and delivery method.
Confirm acceptance of these Terms and Conditions.

3.3. After placing an order, the customer will receive an automated confirmation email.
3.4. The contract of sale is concluded upon confirmation of order acceptance by Emerald Spa.

4. Prices and Payments

4.1. All prices on the website are displayed in Polish zloty (PLN) and include VAT.
4.2. Available payment methods include:

4.3. The Seller reserves the right to change prices or introduce promotions without affecting orders already placed.

5. Delivery

5.1. Products are delivered within Poland and selected EU countries.
5.2. Delivery methods include courier services and parcel lockers (e.g., InPost, DPD, DHL).
5.3. Delivery time depends on availability and destination, typically 3–7 business days within Poland.
5.4. Shipping costs are displayed during the ordering process.
5.5. The risk of accidental loss or damage passes to the consumer upon receipt of the goods.

6. Returns and Right of Withdrawal

6.1. Consumers have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.
6.2. To exercise this right, the customer must send a written statement to:

6.3. The product must be returned in its original, undamaged packaging, unused, and suitable for resale (for hygiene reasons, opened cosmetic products cannot be returned).
6.4. Refunds will be processed within 14 days from the date we receive the returned goods.
6.5. Return shipping costs are borne by the customer.

7. Complaints

7.1. In case of product defects or non-compliance with the order, the customer may file a complaint by email or in writing.
7.2. The complaint should include the order number, description of the defect, and photographs (if applicable).
7.3. The Seller will respond within 14 days of receiving the complaint.
7.4. If the complaint is accepted, the Seller will replace, repair, or refund the product.

8. Account Registration (Optional)

8.1. Customers may create an account to simplify future purchases.
8.2. Registration requires providing an email and password and accepting these Terms and Conditions.
8.3. Users are responsible for keeping their login credentials confidential.

9. Personal Data Protection

10. Intellectual Property

All content, images, and materials on emeraldspa.pl are the property of Emerald Spa and may not be copied, modified, or used without prior written consent.

11. Liability

The Seller is not responsible for interruptions in website availability, delays caused by third parties (e.g., courier services), or events resulting from force majeure.

12. Dispute Resolution

12.1. In case of disputes, the parties shall first seek an amicable settlement.
12.2. Consumers may also use out-of-court dispute resolution through the European ODR platform available at https://ec.europa.eu/consumers/odr.

13. Final Provisions

13.1. These Terms and Conditions are effective from 1/1/2025
13.2. The Seller reserves the right to modify the Terms and Conditions at any time, provided that changes do not affect ongoing orders.
13.3. The governing law is Polish law.
